WELCOME!This Florist Locators Paid Listing Agreement is a legal document that governs the terms and conditions of your paid listing. It is an agreement between you and 2043836 Ontario Limited which owns and operates the Florist Locators website.
By activating your paid listing, you acknowledge your agreement with these terms and conditions and that these terms and conditions may be amended from time to time.
SERVICE PROVIDED, FEES
A paid listing at Florist Locators allows local florists to promote their business by allowing them to display additional information about their store to visitors of the Florist Locators website. Florists with a paid listing keep 100% of all orders that they receive through promotion of their business through Florist Locators. Local florists with a paid listing may receive walk-in orders, order by telephone and online orders - no commissions are due on any orders to Florist Locators.
The fee for a paid listing is a one-time charge of $19.95 USD.
ACCEPTANCE, SIGN-UPFlorist Locators reserves the right to reject any paid listing submission for any reason or no reason. We will automatically reject any business that promotes adult content, hatred, violence or racial intolerance.
We only accept local florist shops with a physical store presence that fulfill flower orders directly without passing the order on to another party.
If we receive a report that a florist in our directory is not a local florist with a physical store presence, we will investigate that claim. We do however ultimately reserve the right to decide which florists are permitted to a paid listing.
Paid listings will appear before unpaid listings for the city in which the paid listing appears. We may rotate the order of paid listings in relation to other paid listings. Your paid listing position may change but it will appear before unpaid listings.
In addition to promoting local florists, Florist Locators does also promote national online florist programs. While we are committed to promoting local florists and providing value to paid listings, we will continue to promote online florist programs and we reserve the right to determine the balance between promoting local florists and national online florist programs. This means that we reserve the right to control and change the layout of pages, appearance and positioning of both paid listings and advertisements for national online florist programs.
During the paid listing sign-up process, you will be asked to create a username and password which will give you access to your account. It is your responsibility to maintain the confidentiality of your password and you are solely responsible for all usage and activity on your account.
You can login to your account to modify your listing at anytime during your listing period. You are required to provide true and accurate listing information and to update your listing information when it changes. Modifications to listings must be approved by a human reviewer and therefore listing changes do not appear on the site immediately. We make our best effort to approve of changes to listings as soon as possible.
Because of the possibility of human or technological errors, Florist Locators is not responsible for any errors or omissions with your paid listing whether it is caused my Florist Locators or by you. We do make our best effort to present your listing information correctly and will act promptly to correct any incorrect information that we discover or that is brought to our attention.
PAYMENTS, BILLING POLICIES
Your credit card will not be automatically re-billed when your listing expires. We may implement an automatic re-billing system in the future at which time you can decide if you want to be automatically re-billed.
Before your paid listing expires, you will receive emails that will notify you that your listing is set to expire and provide you with a method to renew your paid listing if you choose to do so. You are not obligated to renew your paid listing. Your paid listing will be cancelled if you choose not to renew.
2CO is the autorized retailer of the Paid Listing provided by 2043836 Ontario Limited on the Florist Locators website.
TRANSFERING THIS AGREEMENTYou cannot transfer, sell, or assign your paid listing to any third-party. This means that if you sell your florist shop, your paid listing cannot be transferred to the new owner. Any attempt to do so will void this agreement.
COPYRIGHT INFORMATIONAll information on this site is protected by copyrights and other intellectual property rights. You cannot copy, reproduce, republish, download, post or transmit any information on this website for any purpose. Any unauthorized attempt to modify any information is prohibited.
ACCOUNT TERMINATIONYou can terminate your paid listing on our website at anytime. As we are providing a service, we do not refund the payment for your listing if you chose to cancel your listing.
Florist Locators reserves the right to terminate your account at any time for any reason or for no reason.
SITE PROMOTIONFlorist Locators makes its best effort to promote the Florist Locators website in search engines and to gain visitors from other sources of internet traffic. We do not however guarantee any amount of site visitors on the Florist Locators website nor do we guarantee any placement in any search engine.
LIMITATION OF LIABILITYIn no event shall Florist Locators liability to you for damages, losses, and causes of action, whether in contract, negligence, tort or otherwise exceed the amount paid by you.
It is in our interest to keep our site live and functioning at all times and we make our best effort to do so. Due to unforeseen problems including technical problems which may occur, we do not guarantee that our site will be live without impairment or interruption 100% of the time. Florist Locators disclaims any liability from such interruptions including but not limited to consequential damages.
GOVERNING LAW AND DISPUTE RESOLUTIONThese terms and conditions are governed by the laws of Ontario, Canada. The parties agree to submit to the jurisdiction of the courts of Ontario, Canada for a resolution of any dispute resulting from this agreement.
